Cause

An employee wants to apply for and document private practice or consultation activities.

Resolution

Employees at South Dakota's public higher education institutions may engage in private practice, consulting, outside employment, or additional compensated work during their contract period. However, these activities must be conducted in a way that aligns with institutional expectations, supports professional development, and does not interfere with assigned duties.

SDBOR Policy 4.9.2 outlines the conditions that need to be met in order for faculty to participate in private practice, consulting, or other outside employment:

  • The faculty member will not devote more than four (4) days per month for outside activity that requires you to be absent from university duties. The cumulative time shall be a maximum of 6 days during the contract period.
  • The outside activity must be:
    • Substantially related to your assigned university duties, and
    • Support economic development or enhance your professional discipline, as determined by the university’s president or designee.
  • Medical School faculty must adhere to their approved Medical Service Plan for private practice or consultation.

An NFE or CSA employee who enters into private practice, consulting, or outside employment for which leave is required during the course of his or her workday must also receive prior approval.

For faculty and staff seeking approval to engage in private practice or consulting, they must:

  1. Complete the Private Practice and Consultation form through DocuSign one week prior to the start of engaging in such activity.
  2. Ensure the activity does not interfere with your teaching, research, or other assigned responsibilities.
  3. If the activity has not been reported on the annual Conflict of Interest form, reach out to the Human Resources office to determine if a Conflict of Interest form is also needed.
  4. When the activity is completed, fill in the information at the bottom of the form related to dates and hours of service, and provide it to the President’s Office.
